WHAT SHOULD I DO FOLLOWING A DOG BITE?
Here is what you need to do
California is a state where strict liability applies in cases involving dog bites. Therefore when a victim sues to receive compensation, all they must prove is that you were bitten, and not that the owner was careless or negligent in failing to prevent the incident.
The dog owner is strictly liable if the person bitten was in a public place or lawfully in a private place, as long as the victim did not provoke the dog, if the dog was acting in self defence of their owner or if it was a police or military dog acting within reason.
If a dog grabs someone with its teeth but doesn’t break the skin, that could still count as a bite.
You do not need to file a police report following a dog bite, but it may make claiming compensation easier if an animal control officer has investigated the dog and deemed it to be dangerous. Therefore contacting the police or local authorities could work in your favor regarding making a claim.
